Drug Free Workplace FAQs

It’s the desire of every company to provide a safe, healthful drug and/or alcohol-free work environment for its employees.

TO HAVE YOUR INDIVIDUAL PROGRAM...YOU MUST:

  • Develop and adopt a drug and/or alcohol-free workplace policy for your company.
  • Provide copies of that drug and/or alcohol-free workplace policy to all your employees, secure and maintain certification that they have received copies before any test can be done. Failure to do this is a violation of the employees’ civil rights.
  • Select a SAMHSA-approved (Substance Abuse Mental Health Services Administration) drug test laboratory (only a limited number in the entire U.S.). If you use other than a SAMHSA-approved lab, the results can be easily challenged and may have to be redone at your expense.
  • Use only properly trained “Screening Test Technicians” (STT) and/or “Breath Alcohol Technicians” (BAT) for any alcohol tests.
  • All alcohol tests shall be on a non-evidential alcohol screening device and/or an “Evidential Breath Testing” device (EBT) that is on the current federally-approved list.
  • Develop all necessary forms to meet precise chain of custody standards. This is for your protection!
  • Engage qualified personnel to collect urine samples. They must collect the samples according to a precise procedure and chain of custody standard.
  • Locate a qualified courier service.
  • Select a qualified medical review officer (must be a licensed physician with MRO certification and undergo continuing education, and must have knowledge and clinical experience in controlled substances abuse disorders).
  • Develop annual review forms and procedures.
  • Insure that all of the above meets basic federal and state standards as well as rules of evidence in court, to protect you from potential liability and financial loss.

  • Send you an individualized drug and/or alcohol-free workplace policy developed for your company.
  • Send you all the appropriate forms to have a legal drug and/or alcohol-free workplace testing program. Free updates as needed.
  • Provide for you the proper chain of custody of the samples by qualified personnel.
  • Provide for you the collection of urine samples by qualified personnel.
  • Provide for you alcohol testing by a qualified Screening Test Technician and/or a qualified Breath Alcohol Technician.
  • Provide co!lections at your location if you desire.
  • Provide for you air courier services for urine samples to be air expressed to a federally-approved SAMHSA laboratory.
  • Provide for you a quality test of all your samples (confirmation test is free, which protects you on all positive, adulterated or substituted results: other groups may charge an additional fee for this second test).
  • Provide for you a qualified Medical Review Officer who will review all laboratory drug test results.
  • Provide and/or assist you with annual record keeping.
